1. Agreement
These Terms of Service ("Terms") govern your access to and use of Telefonely (the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
2. Service description
Telefonely provides an AI-powered phone receptionist that answers, routes, transcribes, and summarizes calls on your behalf, along with related dashboard, analytics, and SMS notification features. Features and availability may change as the Service evolves.
3. Accounts
You must provide accurate information when creating an account and keep your credentials secure. You are responsible for all activity that occurs under your account.
4. Acceptable use
You agree not to:
- Use the Service for any unlawful, harmful, or fraudulent purpose.
- Use the Service to send spam, unsolicited marketing, or any communication that violates the TCPA, CAN-SPAM, or other applicable laws and carrier rules.
- Place or facilitate robocalls, autodialed calls, or messages without proper consent from recipients.
- Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its underlying systems.
- Reverse engineer, resell, or sublicense the Service without our written permission.
We may suspend or terminate accounts that violate these rules.
5. SMS messaging consent
By providing a mobile phone number and opting in, you consent to receive SMS messages from Telefonely related to your account and the Service (such as appointment confirmations, call summaries, and account alerts). Message frequency varies. Message and data rates may apply. You can opt out at any time by replying STOP to any message, or reply HELP for assistance. Consent to receive SMS is not a condition of purchase. See our Privacy Policy for details on how we handle mobile phone numbers and opt-in data.
When you use Telefonely to send messages to your own customers, you are responsible for obtaining all required consents and complying with all applicable messaging laws and carrier requirements.
6. Billing and subscriptions
Paid plans are billed in advance on a recurring basis (monthly or annually, depending on the plan you choose). Usage above your plan's included call minutes may incur overage charges at the rates shown on our pricing page. All fees are non-refundable except as required by law. We may change pricing with prior notice; changes take effect on your next billing cycle.
7. Cancellation
You may cancel your subscription at any time from the billing section of your dashboard. Cancellation takes effect at the end of the current billing period, and you will retain access to paid features until then. We do not provide prorated refunds for partial billing periods. We may suspend or terminate your account for non-payment or violation of these Terms.
8. Your content and data
You retain ownership of the call recordings, transcripts, and other content you generate through the Service. You grant us a limited license to process this content as needed to operate and improve the Service. You are responsible for ensuring you have the right to record calls and process caller information in your jurisdiction.
9. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated outputs will be accurate.
10. Limitation of liability
To the maximum extent permitted by law, Telefonely and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or business opportunities, arising out of or related to your use of the Service. Our total aggregate liability for any claim arising out of or relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
11. Indemnification
You agree to indemnify and hold Telefonely harmless from any claims, damages, or expenses arising out of your use of the Service, your content, or your violation of these Terms or applicable law.
12. Changes to these terms
We may update these Terms from time to time. Material changes will be posted on this page with a new "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
